The notion of the commons must be used with caution today, as it is polysemous. It can encompass a wide variety of tangible and intangible assets, for social purposes, and can sometimes be instrumentalized for a political project.

The emergence of the concept of the commons reflects a clear shift in the conception of property, where the exclusive right of a single landowner is being challenged by a return to the old pluralism, and by rights over knowledge, which are being challenged by open access.

The old commons contain elements of preservation that can be adapted to the current, different context.

The notion of collective management of a land resource or a non-appropriable asset (water, air) to maintain its quality can constitute a way of being together by reconciling private and public action, and cooperation among local stakeholders around a project. This requires an adaptation of the law and a new approach to co-construction.
